PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING THIS SITE OR USING ANY PART OF THE SITE OR ANY CONTENT OR SERVICES ON THE SITE, YOU AGREE TO BECOME BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS, THEN YOU MAY NOT ACCESS THE SITE. YOUR USE OF THE SITE IS EXPRESSLY CONDITIONED UPON YOUR ASSENT TO ALL OF THESE TERMS AND CONDITIONS, TO THE EXCLUSION OF ALL OTHER TERMS.
 

1. General

1-1 All our shipping and services are subject to the following sales-, delivery-, and payment conditions.
1-2 On all rights, commitments, obligations, special offers, orders and agreements under which these general conditions apply, explicitly and unconditionally follow and will be judged under New Zealand law.
 

2. Prices

2-1 All prices are in Australian dollars and will be as quoted on our site. All prices are inclusive of GST and exclusive shipping and handling charges. 2-2 The applicable GST is applied to items in accordance with applicable laws.
2-3 Prices are subject to change at any time, but price changes will not affect orders in respect of which simply colors has already sent a confirmation as per paragraph 4 of these Terms and Conditions
 

3. Postal charges

3-1 For the shipment of clothing simply colors charges a postage.
3-2 The postal charges for orders in Australia is $6.00 for one item and for two or more $8.
3-3 Depending on the weight and volume of the order it will be shipped in an envelope or package. Outside Australia different postal charges apply.
3-4 Depending on the size of the order the delivery fees will be free or reduced. Shipment in New Zealand and Australia is free if the order exceeds $125.
 

4. Payments

4-1 After ordering you will receive a confirmation e-mail with your order number, an overview of your order and total costs, including the postal charges.
4-2 Every order will be delivered after we have received the payment. You can pay with:
4-3 direct and online with creditcard (Mastercard and Visa).
4-4 through money transfer. Payment needs to be completed within seven working days following the order date, we will then
ship the order. During these days simply colors will reserve all ordered items for you. In case we do not receive the payment within this period the items will be made available for sale again.
4-5 Simply colors will send a confirmation e-mail when your payment has been received.
 

5. Shipping

5-1 All items are presented for postage within five working days after receiving the payment.
5-2 If for any reason we can not post you order within five working days we will get in touch with you by telephone or e-mail.
5-3 An e-mail will be sent confirming that the order has been shipped.
5-4 In general post is delivered within two days to 4-6 days with Australia.
5-5 All clothes are deliverable from stock. In case an article is temporarily out of stock you will be notified immediately.
5-6 Simply colors is not responsible for any excess delivery time or loss and damage by the delivery agent.
 

6. Exchangeable

6-1 Simply colors does everything in its power to deliver a perfect product. Despite this, if you are not satisfied with your order (or part of it), then you can return it free of charge within seven days after delivery subject to clause 6-5).
6-2 This is only possible if you notify simply colors by e-mail beforehand.
6-3 After receiving the return simply colors will transfer the amount (excluding the postal charges) onto you credit card used for purchase or credit your bank account within 5 days.
6-4 If the size or colour of the item you have received is not correct, then you can always exchange this. Exchanging is done on shared postal charges.
6-5 Items are not exchanged and returned when:

  • the cloths are printed
  • the cloths have been worn or washed
  • you have tried to repair the item yourself
  • you have not correctly followed the user instructions
     

6-6 In case you has (partially) received a wrong order, then simply colors will make sure that the proper items are sent.

 

7. Liablility

7-1 All products in the collection of simply colors are subject to tight quality requirements according European law with which baby- and children clothing need to comply. Simply colors can not be held liable for any damage, physically as well as material and immaterial, as a consequence of wrong performance or use of the products sold by simply colors.
7-2 The content of this website has been carefully composed. Simply colors can not exclude that certain information is not correct or incomplete. Simply colors is not liable for any consequences as a result of incorrect or incomplete information on their website.
7-3 Simply colors is not responsible for any type or print errors trough which unintentional price differences are communicated.
In case the later does occur the price will be corrected as soon as possible by simply colors.
7-4 Simply colors can not be held accountable for any difference in colour as a result of computer monitor quality.
7-5 The position and size of the actual print on the piece of clothing can differ slightly as compared to the display on the website.
Simply colors can not be held responsible for this.
 

8. Circumstances beyond our control

Keeping in account further rights coming forth, simply colors has in case of circumstances beyond their control the right to,in choice of their own, exercise a delay, according the agreement. In this case it is not possible to judge lawfully the result of this action as well as to not claim any financial compensation from simply colors. Unless in given circumstances the issues are unreasonable and unacceptable.
 

9. Privacy

All personal information given to us will only be used by simply colors and will never be made available to third parties, unless required for payment purposes and delivery requirements to complete the order process.

Simply colors aims for customer satisfaction. If in any case you might have questions or complaints about our services and/or products of simply colors, then we request that you contact us by telephone or e-mail.
